The High Court held that retrospective cancellation cannot be mechanical; the officer must have objective material, must put the taxpayer on notice of the intention to cancel from a back date, and must consider the consequence that customers lose their input tax credit. The cancellation was confined to the date from which the taxpayer had sought cancellation.
What to do about it: If your registration was cancelled from a back date, check whether the show cause notice ever mentioned retrospective effect — that omission alone has repeatedly got such orders modified.

Schedule III carries twenty per cent central tax, that is forty per cent combined, and is deliberately short. It covers aerated waters and other beverages containing added sugar or sweetening matter, caffeinated beverages, carbonated beverages of fruit drink, larger motor cars and hybrids above the small-car limits, motorcycles above 350 cc, aircraft for personal use, yachts and pleasure vessels, revolvers and pistols, smoking pipes and cigarette holders, and specified actionable claims such as betting, casinos, lottery and online money gaming.
What to do about it: Only a narrow list attracts forty per cent, so a supplier pushed into that slab by an officer should check whether the goods actually appear in Schedule III.
CBIC Instruction No. 03/2025-GST · 2025-04-17
Responding to widespread complaints about arbitrary queries, CBIC directed registration officers to seek only the documents listed in Form GST REG-01. For rented premises a valid rent agreement with the owner's ownership proof suffices; for owned premises any one ownership document is enough; no-objection certificates suffice for consent premises. Officers must not demand physical originals, question the applicant's residential address or business activity, or raise presumptive queries, and any query must be specific and approved by the Deputy or Assistant Commissioner.
