The 41st meeting was convened with a single agenda item, GST compensation to states and union territories, after collections collapsed during the pandemic. The Centre placed before the Council two borrowing options for meeting the compensation shortfall for 2020-21: a special window facilitated by the Reserve Bank of India for the portion of the shortfall attributed to GST implementation itself, or market borrowing of the entire estimated shortfall by the states, in both cases serviced from future compensation cess collections. States were given a short period to convey their choice.
What it means for you: The borrowings arranged here are why compensation cess continued to be collected on cess goods long after the five-year compensation period ended in June 2022.

A transporter sought release of detained goods. The Court dismissed the petition, holding that under Section 129 the entitlement to seek release of goods lies only with the owner, his agent or representative. The transporter's remedy is confined to release of the conveyance on payment of the penalty or one lakh rupees, whichever is less. Any claim about payment of tax on the consignment has to be pursued by the assessee who owns the goods, not by the carrier.
Why this matters: When a Chennai consignment is detained, the consignor or consignee must file the release application in its own name; letting the lorry operator do it will cost time.

CBIC laid down the prerequisites for an intermediary. There must be a minimum of three parties, and two distinct supplies, the main supply between two principals and the ancillary supply of arranging or facilitating it. The supplier must have the character of a broker or agent playing a supportive role, and a person supplying goods or services on his own account on a principal-to-principal basis is not an intermediary. Sub-contracting is expressly excluded, and illustrations are given for software support and marketing services.
