Exercising its powers under Article 142, the Supreme Court directed that the period from 15 March 2020 to 28 February 2022 shall stand excluded in computing limitation for any suit, appeal, application or proceeding, whether under general law or any special law. Where the balance limitation remaining was less than ninety days, a fresh period of ninety days from 1 March 2022 was granted. Statutory authorities were bound by this direction.
Practical effect: Chennai businesses contesting demands or appeals covering the pandemic years should compute limitation after excluding this period, which often revives an apparently time-barred claim.

CBIC clarified several refund issues: the value of export goods, for both 'turnover of zero-rated supply of goods' and 'adjusted total turnover' under Rule 89(4), is the lower of the FOB value declared in the shipping bill and the value declared in the tax invoice; the scope of the undertaking required in Form RFD-01 in relation to Section 16(2)(c) was explained; refund of accumulated credit is admissible even where the credit pertains to invoices of an earlier period but was availed in the refund period; and the manner of computing refunds where GSTR-2B based restrictions apply was set out.
What it means for you: Exporters should compute refund claims using the lower of FOB and invoice value and cite this circular when officers seek unwarranted undertakings or reject earlier-period credit.

GSTN removed the requirement to select a refund period in chronological order for certain refund categories, so a claim need not follow strict sequence, and moved those categories to invoice-based filing. For export of services with payment of tax, supplies to special economic zone units with payment of tax, and deemed export claims by the supplier, the applicant uploads the specific invoices in the relevant statement and those invoices are then locked against a repeat claim. All returns due up to the date of the claim must be filed.
