What the department must do before assessing a non-filer to best judgment

Circular No. 129/48/2019-GST dated 24 December 2019 · 2019-12-24

CBIC prescribed a uniform procedure for non-filers. A system-generated reminder goes out three days before the due date, followed by a notice in FORM GSTR-3A after the due date giving fifteen days to file. If the return is still not filed, the officer may assess the liability to the best of his judgment under section 62 and issue an order in FORM GST ASMT-13. That order is deemed withdrawn if the taxpayer files the valid return within thirty days of service.

Practical effect: An ASMT-13 best-judgment order is not the end; filing the missing return within the statutory window from service makes it fall away automatically.

Autoclaved aerated concrete (ACC) blocks containing more than 50 per cent fly ash content were classified under HS 6815 at 12 per cent. The Council also reduced the rate of compensation cess to 0.1 per cent on supplies to merchant exporters, bringing it on par with the concessional 0.1 per cent GST rate on such supplies.

Rule 159(5) gives you the immediate remedy: file an objection before the Commissioner, within seven days of the attachment, contending that the property was not liable to attachment, and seek a personal hearing. If satisfied, the Commissioner releases the property through Form DRC-23. In practice, offering less disruptive security, demonstrating that the attachment cripples salaries and statutory payments, or showing that the underlying proceedings do not fall within Section 83 are effective grounds. Where the Commissioner refuses, a writ petition before the Madras High Court is the established route for Saligramam businesses, since no appeal is provided against DRC-22. Section 83 empowers the Commissioner, where he records an opinion that protecting revenue requires it, to provisionally attach property including bank accounts during the pendency of specified proceedings, such as assessment, inspection or demand cases. The attachment order is issued in Form DRC-22 and a copy goes to your bank, which freezes debits. Crucially, the attachment automatically ceases to have effect after one year from the order, and it can be lifted earlier through Form DRC-23 if the Commissioner is satisfied. Courts insist the power is draconian and must be exercised with genuine, recorded reasons, which is a strong ground of challenge in suitable cases.
I got a show cause notice in REG-17 threatening cancellation of my GST registration. What should I do?
Form REG-17 is issued when the officer proposes to cancel your registration, commonly for continuous non-filing of returns, non-existence at the declared premises or wrongful ITC availment. You must reply in Form REG-18 within seven working days and attend the hearing if one is fixed. If the reply satisfies the officer, proceedings are dropped in REG-20; otherwise cancellation is ordered in REG-19. If cancellation happens, you can seek revocation in Form REG-21 within ninety days after filing all pending returns and paying dues. Because cancelled registrations freeze e-way bills and invoicing, treat a REG-17 in Saligramam as urgent.
Should I just pay the amount mentioned in a DRC-01A intimation?
