Notification No. 09/2022-Central Tax · 2022-07-05
This notification brought into force, with retrospective effect from 1 July 2017, the Finance Act, 2022 amendment to Section 50(3) of the CGST Act. Interest at eighteen per cent is now chargeable only where input tax credit has been wrongly availed and utilised, and not where it has merely been availed and reversed without being used to discharge output tax. The effective rate on wrongly utilised credit is eighteen per cent, against the twenty-four per cent that had applied under the earlier provision. Rule 88B, inserted by Notification No. 14/2022-Central Tax of the same date, prescribes how utilisation is to be measured.
What to do about it: If a Chennai business reversed a wrong credit before using it, no interest is payable at all, and any contrary demand should be resisted with this notification.
Circular No. 225/19/2024-GST · 2024-07-11
Building on the earlier corporate guarantee circular, the Board clarified that the special valuation rule in Rule 28(2) applies to guarantees issued or renewed on or after 26 October 2023, and that the one per cent value is to be read as one per cent per annum of the guarantee amount, apportioned where the guarantee runs for a shorter period. It also confirmed that where the recipient is eligible for full input tax credit, the value declared in the invoice is deemed to be the open market value.
What it means for you: Chennai promoters and holding companies giving guarantees for group borrowings should compute the value annually and, where the borrower takes full credit, can adopt the invoice value.

To back up the registration processing instruction, CBIC required every CGST Zone to publicise a dedicated email address for registration grievances on its website and on the notice board of the concerned office. Applicants aggrieved by improper queries, unjustified rejection or delay may write to that address with the application reference number; the zone must examine the grievance, take corrective action and report the disposal to the Directorate General of GST periodically.
Practical effect: A registration rejected on flimsy grounds need not go straight to appeal; the zonal grievance email often gets the application reopened far faster.
