Where an Indian transporter supplies goods transport services to a registered Indian recipient but the destination of the goods is outside India, the proviso to Section 12(8) of the IGST Act fixed the place of supply outside India. The Board clarified that this remains an inter-State supply on which integrated tax is payable, that the supplier must report it correctly in GSTR-1, and that the Indian recipient is entitled to input tax credit. The proviso itself was later omitted with effect from 1 October 2023.

The Chennai company provided management consultancy and detailed project report services to the Chennai Metro Water Supply and Sewerage Board for water related projects. It asked whether the service attracted GST. The Authority held that the supply was a pure service with no supply of goods involved, rendered in relation to a function entrusted to a municipality, and was therefore exempt from GST under the entry covering pure services supplied to government and local authorities.

Dealing with Section 19(11) of the Tamil Nadu VAT Act, the Supreme Court held that input tax credit is a concession created by statute and not an absolute or constitutional right. The legislature may impose conditions, including a time limit for claiming it, and such a limit is mandatory rather than directory. A dealer who claims credit after the prescribed period loses it. This reasoning is routinely applied to Section 16(4) of the CGST Act.
Practical effect: Chennai businesses must claim input tax credit within the statutory deadline, since courts have consistently refused relief for late claims.
