Following High Court rulings on the constitutional requirement to inform an arrested person of the grounds of arrest, CBIC revised its arrest guidelines. The grounds of arrest must be explained and furnished in writing to the person as an annexure to the arrest memo, and written acknowledgement of receipt must be obtained. This supplements the earlier requirement that arrest be based on reasons to believe recorded in writing, with approval of the Commissioner, and only for offences crossing the prescribed thresholds.
Why this matters: If a summons escalates towards arrest, insist on written grounds of arrest, as their absence has repeatedly led courts to set aside GST arrests.

Because the GST Appellate Tribunal was not yet operational, CBIC directed that taxpayers who lost their first appeal could pay the additional pre-deposit required for a Tribunal appeal through the electronic liability register and file an undertaking to appeal once the Tribunal starts functioning. On doing so, recovery of the balance confirmed demand stands stayed under Section 112(9). Officers were told not to coerce full payment merely because the appellate forum was unavailable.
What to do about it: After an unfavourable first-appeal order, paying the ten per cent Tribunal pre-deposit with an undertaking legally halts recovery until GSTAT hears the case.

A best-of-judgment assessment of about Rs 5 lakh was raised for non-filing of the April 2023 return, the dealer contending that the real liability was about Rs 2 lakh, which was paid once the assessment came to its notice. The Madras High Court permitted the dealer to file an application for condonation of the delay in filing the return and directed the State Tax Officer to consider that application sympathetically in the light of the Court's earlier precedent. The writ petition was disposed of on those terms without any order as to costs.
What to do about it: Where late returns have triggered adverse consequences, a formal condonation application supported by reasons is the correct first step in Tamil Nadu.
