Allowing the department’s review petition, the Court recalled that decision on 7 November 2024. It held that the earlier ruling had overlooked relevant statutory provisions and notifications, and concluded that DRI officers are competent proper officers under Section 28. Demands earlier quashed on the Canon India ground were revived and directed to be decided afresh on merits.
Why this matters: Chennai importers who obtained relief only on the Canon India jurisdiction point must now be ready to defend those customs demands on merits; the identity and jurisdiction of the issuing officer is still worth checking, but this particular ground no longer survives.

CBIC then clarified that additional interest charged for delayed payment under the loan agreement itself is part of exempt interest, while charges levied under a separate agreement are taxable, and a further 2025 circular clarified that penal charges levied by banks and non-banking finance companies for breach of loan terms are not taxable.
