Printing leaflets on the printer's own paper attracts 18 percent

Coronation Arts Crafts - AAR Tamil Nadu, Advance Ruling No. 19/ARA/2022, dated 31 May 2022 · 2022-05-31

A printing house printed leaflets and similar material using content supplied by the customer but paper, ink and other physical inputs of its own. It asked for the correct classification and rate. The Authority held that this is a composite supply in which the printing service is the principal supply, and the supply is therefore taxable at 18 percent. The customer supplying only the content or artwork did not alter the classification.

What it means for you: A Chennai printer supplying its own paper should charge 18 percent on job printed leaflets instead of assuming a lower book rate.

Karnataka High Court: trading in vouchers is neither supply of goods nor services

Premier Sales Promotion (P) Ltd v. Union of India — Karnataka High Court, 2023 · 2023-01-16

A company procuring and supplying prepaid vouchers, gift cards and e-vouchers to corporate clients was held liable to GST by the AAR and AAAR. The Karnataka High Court reversed, holding that vouchers are in the nature of pre-deposit instruments or actionable claims — a means of payment for future supplies — and their mere trading is neither a supply of goods nor of services, so no GST is payable on the voucher itself. CBIC later clarified voucher taxation consistently with this position.

What imprisonment terms does GST law prescribe, and which offences are non-bailable?
Section 132 links punishment to the amount involved: imprisonment up to five years with fine where the tax evaded or credit misused exceeds Rs.5 crore, up to three years where it exceeds Rs.2 crore, and up to one year for the Rs.1 crore to Rs.2 crore band, which after the Finance Act 2023 changes survives only for the offence of issuing invoices without supply. Can a person who never filed the returns still be penalised in a fake invoice case?
Yes. Section 122(1A) targets the person at whose instance fake transactions are conducted and who retains the benefit, even if the invoices were issued through some other entity. Where the offence involves supplying without an invoice, issuing invoices without supply, or availing or passing on credit from such invoices, the beneficiary faces a penalty equal to the tax evaded or the credit availed or passed on. This is how masterminds behind billing rackets are penalised alongside the front companies. What is Form DRC-03 and when should I use it?

In a Section 73 matter, paying with interest at this stage means zero penalty, which is a genuine saving. What is the difference between a Section 73 and a Section 74 notice?
Section 73 covers short payment of tax or wrong ITC without fraud, while Section 74 applies where the department alleges fraud, wilful misstatement or suppression of facts to evade tax. The stakes differ sharply. Under Section 73 the order must be passed within three years from the annual return due date and the penalty is 10 percent of the tax or Rs.10,000, whichever is higher, with no penalty if you pay before the notice. Under Section 74 the limit is five years and penalty can equal 100 percent of the tax. Contesting a wrong invocation of Section 74 is often the first line of defence.
What are the rules for numbering GST invoices?
The invoice serial number must be consecutive, must not exceed sixteen characters, and may contain alphabets, numerals and the special characters hyphen and slash, in one or multiple series. Each number must be unique for a financial year, so most businesses restart their series every April with a year prefix such as 2026-27/001. Gaps in a series invite questions during audit because officers may suspect unreported invoices, and cancelled invoice numbers should be retained in records with the cancelled copy. The document series you use must also be declared in Table 13 of GSTR-1 each period.
Is the late fee charged on delayed returns the same thing as a penalty?
No, they are legally distinct. Late fee under Section 47 is an automatic, fixed daily charge for filing a return after its due date, computed by the portal and payable in cash before the return is accepted; no officer discretion or notice is involved. Penalty, under provisions such as Sections 122 to 125, is imposed through adjudication for specified offences, requires a show cause notice and hearing, and can be contested or reduced. Interest under Section 50 is a third, separate levy compensating for delayed payment. A delayed return with tax due can therefore attract all three simultaneously, each on its own footing.
My footwear shop sells chappals at Rs.300 and shoes at Rs.4,000 on the same bill. How do I invoice this?
One invoice can comfortably carry both rates. Each pair is tested against the Rs.2,500 sale-value threshold independently, so the chappals are billed at 5% and the Rs.4,000 shoes at 18%, as separate line items under their footwear HSN codes in Chapter 64.
