Note that GST law was later amended, with retrospective effect from 1 July 2017, to specifically tax supplies between a club or association and its members.

Circular No. 145/01/2021-GST dated 11 February 2021 · 2021-02-11

Rule 21A(2A), inserted with effect from 22 December 2020, permits immediate suspension of a registration where a comparison of the returns filed under section 39 with the outward supplies reported in FORM GSTR-1, or with the inward supplies derived from the GSTR-1 filed by the taxpayer's own suppliers, shows significant differences or anomalies indicating contravention of the Act. CBIC directed that the taxpayer be intimated in FORM GST REG-31, or by email until that form is available on the portal, and be given thirty days to explain, after which the suspension is revoked or cancellation proceeds.

Practical effect: A suspension notice must be answered within thirty days with a reconciliation, because ignoring the REG-31 intimation leads straight to cancellation.

No. The statute excludes several categories. A person who has already been allowed to compound once in respect of the specified serious offences cannot compound again. Persons accused of issuing invoices without any supply of goods or services, the classic fake billing offence, were excluded from compounding altogether by the Finance Act 2023, and anyone convicted by a court under the GST law is also barred. Notably, the same 2023 amendments removed the earlier bar on compounding where the conduct was also an offence under another law, so that ground no longer disqualifies an applicant. Eligibility should be assessed before paying the underlying dues, since payment is a precondition but not a guarantee of compounding.
How can I verify whether a GST notice I received is genuine or fake?
Every communication from a central GST officer must carry a Document Identification Number (DIN), which you can verify on the CBIC website. Notices issued through the GST portal carry a Reference Number that can be checked after logging in, and a genuine notice will also appear in your View Notices and Orders or View Additional Notices and Orders tab. As per CBIC instructions, a communication without a DIN is treated as invalid. Be cautious of demands received only on WhatsApp or email asking for payment to personal accounts. What penalties does Section 122 of the CGST Act prescribe, and for which offences?

Can a person who never filed the returns still be penalised in a fake invoice case?
Yes. Section 122(1A) targets the person at whose instance fake transactions are conducted and who retains the benefit, even if the invoices were issued through some other entity. Where the offence involves supplying without an invoice, issuing invoices without supply, or availing or passing on credit from such invoices, the beneficiary faces a penalty equal to the tax evaded or the credit availed or passed on. This is how masterminds behind billing rackets are penalised alongside the front companies. What is the difference between a Section 73 and a Section 74 notice?

Is GST payable under reverse charge on payments made to our company directors?
It depends on the capacity in which the director is paid. Yes, he is right. A buyer can claim input tax credit only for invoices appearing in his GSTR-2B, which is generated from suppliers' GSTR-1 and IFF filings. If you file GSTR-1 after the 11th, your invoices miss that month's GSTR-2B and your customer's credit gets pushed to the next month, straining his working capital.
