Circular No. 178/10/2022-GST · 2022-08-03

The Board held that liquidated damages paid for breach of contract are a flow of money compensating for injury, not consideration for any service, so no GST applies. The same reasoning covers notice pay recovered from employees, cheque dishonour charges, fines and penalties for violation of a contract or a law, and forfeiture of salary or bond amounts, unless there is a genuine independent agreement to tolerate an act. A late payment surcharge or fee is treated differently, as it is naturally bundled with the principal supply and forms part of its value.

A landowner obtained approval to develop agricultural land into residential plots and proposed to sell the plots after laying roads, drainage, water lines and other common facilities required by the plan sanction. The Gujarat Authority for Advance Ruling held that the sale price includes the value of development works, so the transaction is a taxable supply of construction service and not a bare sale of land. CBIC later clarified that sale of land after levelling, laying drainage lines and similar works is still sale of land under Schedule III and outside GST.

Penuel Nexus (P) Ltd v. Additional Commissioner, Headquarters (Appeals) — Kerala High Court, judgment dated 13 June 2023 · 2023-06-13
An appeal under Section 107 was filed after the three-month period and beyond the further one month that the appellate authority may condone. The Kerala High Court held that the CGST Act is a special statute providing its own complete limitation scheme, and the appellate authority has no power to condone delay beyond the additional one month. A writ petition could not be used to bypass that statutory bar. The rejection was upheld.
Practical effect: Treat the four-month outer limit for a GST appeal as real — the safer course is always to file within three months of receiving the order.
