The taxpayer argued that once the State GST authorities had taken up his case, Section 6(2)(b) barred the Central intelligence wing from issuing summons on the same subject. The Division Bench drew a distinction between a 'proceeding' such as assessment, adjudication or recovery, and an 'inquiry' under Section 70. The bar in Section 6(2)(b) applies only to overlapping proceedings on the same subject matter, and does not prevent an intelligence-based inquiry by the other authority. The summons was upheld.
What to do about it: A Chennai business already under State GST scrutiny cannot refuse a DGGI summons on cross-empowerment grounds, though it can still object if the Centre later starts a parallel adjudication on the identical issue and period.
CBIC Instruction No. 03/2025-GST · 2025-04-17
Responding to widespread complaints about arbitrary queries, CBIC directed registration officers to seek only the documents listed in Form GST REG-01. For rented premises a valid rent agreement with the owner's ownership proof suffices; for owned premises any one ownership document is enough; no-objection certificates suffice for consent premises. Officers must not demand physical originals, question the applicant's residential address or business activity, or raise presumptive queries, and any query must be specific and approved by the Deputy or Assistant Commissioner.
What to do about it: If a registration query asks for documents outside the prescribed list, cite this instruction in your REG-04 reply and escalate to the jurisdictional Commissioner if it persists.
32nd GST Council Meeting, New Delhi — 10 January 2019 · 2019-01-10
The Council created two threshold limits for exemption from registration and payment of GST for suppliers of goods, Rs 40 lakh and Rs 20 lakh, and gave states a week to choose which limit would apply in their territory. The threshold for service providers was left unchanged at Rs 20 lakh, and at Rs 10 lakh for special category states. The change was made operational from 1 April 2019 and remains the basic registration test for traders and manufacturers today.
Practical effect: A Chennai trader dealing only in goods crosses the registration line at Rs 40 lakh of aggregate turnover, but a service provider must register at Rs 20 lakh.
